Terms & Conditions
Terms & Conditions of Agreement:
- Rooms or packages are subject to availability.
- The Management or Resort Operators or Transportation Company reserves the absolute right to add, delete and make change to the rates, terms and conditions at any time without prior notice.
- The Management or Resort Operators or Transportation Company reserves the right to review rates, package offered and package program at any time without prior notice.
- The entrance fees, surcharges, miscellaneous or incidental charges are excluded unless otherwise specified.
- The Management or Resort Operators or Transportation Company reserve the rights to alter any itinerary, substitute a vehicle or cancel a tour due to bad weather or unforeseen operational condition.
- Any late special request for the Flight ,Land & Boat Transfer, other than the schedule stated above shall be subjected to additional charge. The Management or Resort Operators or Transportation Company reserve the right to reschedule or cancel the transportation departure due to sky , sea and weather condition.
- The Management or Resort Operators or Transportation Company is not responsible to bear any additional cost occurred due to unforeseen circumstances such as bad weather.
- The Management or Resort Operators or Transportation Company reserve the right to change or cancel any portion of the itinerary or change of departure time without the risk of liability due to safety reasons or unforeseen circumstances.
- The passenger is responsible for own consequences of arriving late at the pick up point or check in point.
- The Management or Resort Operators or Transportation Company reserve the right to determine the type of ferry or transport to be used.
- The weather, sky, wind, sea conditions and water visibility is outside or beyond the operator control.
- The risk of damage or lost of personal belongings in the accommodation ,flight , ferry or transport and platform remain with the passenger.
- The activity in tour services that is not been used will not be refunded.
- All tour members taking part in any activities organized by The Management or Resort Operators or Transportation Company shall do so at their own risk. The Management or Resort Operators or Transportation Company shall not responsible for any losses or injury sustained by anyone. All tour members are advised to insure themselves against injuries and loss of personal belongings.
- The Management or Resort Operators or Transportation Company accept no liability for losses incurred due to failure to connect with other services management and cannot be held liable for lost of baggage or personal items, illness, injury, or death resulting from activities in which are beyond our control.
- The Management or Resort Operators or Transportation Company reserves the right to remove any tour members whose conduct / behavior is detrimental to the management or resort operators or to The Management or Resort Operators or Transportation Company’s other guest.
- The Management or Resort Operators or Transportation Company is not responsible for any difficulties which might arise should your guest is caught for any action against Government rules and laws.
- Guest is responsible to bear any additional cost besides those stated in the package and no credit facilities will be given.
- The Management or Resort Operators or Transportation Company’s reserves the right to inform any last minute closed out date by giving prior notice.
- A confirmation booking is valid for travel on departure date and name specified only.
- No change in name is allowed.
- The Management or Resort Operators or Transportation Company are not liable for any wrong or incomplete disclosure of name and passport number in the booking.
- Upon confirmation of booking, deposit 50% or full payment is required. Base on the resort requirement.
- Full payment must be settled at least 4 weeks or earlier before tour departure. Base on resort requirement.
- In case of cancellation, no show or reduce rooms, the deposit or full payment will be forfeited automatically.
- Cancellation is non refundable in full or in part. There shall be no refund of any deposit.
- In the event our hotels are running a very high occupancy, early reconfirmation of bookings may be required and is subject to the discretion of The Management or Resort Operators or Transportation Company。
- Guest / Group must check in with the original travel voucher that is issued after full payment.
- Payment can be made by Cash or Bank Transfer.
- Please note that cheque payment will only be accepted if received not less than 3 working days before arrival date.
- Seasonality please refer to the seasonal chart
- All rates quoted are Nett pricing and non – commissionable.
- All transaction is deals in Malaysia Ringgit.
- No Travel Insurance coverage. Customer advice to purchase with insurance company.
- The Management or Resort Operators or Transportation Company is not responsible to bear any additional cost occurred due to unforeseen circumstances such as war, terrorism, strikes,riot , nature disaster , virus , pandemic or Enforcement Movement Control by Local or Visit Country Government.
Terms & Conditions of Agreement:
- DEFINITIONS
- Company – “Company” refers to Jouis Holiday Travel And Tour Sdn Bhd, acting as a travel intermediary, booking agent, coordinator, and facilitator for travel-related services.
- Customer – “Customer” refers to any individual, group, organization, or entity that makes a booking, payment, inquiry, or utilizes services arranged by the Company.
- Supplier – “Supplier” means any independent third party engaged, contracted, appointed, or involved in providing travel-related goods or services, including but not limited to airlines, charter flight operators, helicopter operators, seaplane operators, cruise operators, ferry operators, yacht operators, boat operators, transportation providers, railway operators, bus and coach operators, hotels, resorts, villas, apartments, theme parks, attraction operators, activity providers, tour guides, visa agencies, insurance providers, and governmental or regulatory authorities.
- Services – “Services” refers to all travel-related arrangements, bookings, packages, itineraries, transportation, accommodation, tickets, tours, visa assistance, and related services provided through the Company.
- GENERAL
- These Terms & Conditions apply to all Services provided by the Company.
- By making any booking, payment, or participation, the Customer is deemed to have accepted these Terms.
- The Company acts strictly as an intermediary between Customers and Suppliers.
- The Company reserves the right to amend these Terms at any time without prior notice.
- ROLE OF THE COMPANY
- The Company arranges and coordinates travel-related services through independent third-party Suppliers including but not limited to airlines, helicopter operators, seaplane operators, cruise operators, ferry operators, yacht operators, boat operators, transportation providers, railway operators, bus and coach operators, cable car operators, tram operators, hotels, resorts, villas, apartments, guesthouses, theme parks, attraction operators, restaurants, local tour operators, activity providers, diving operators, visa agencies, insurance providers, government authorities, and other related service providers (“Suppliers”).
- The Company does not own, operate, manage, or control any Supplier and shall not be liable for any act, omission, negligence, delay, cancellation, operational failure, bankruptcy, insolvency, misconduct, injury, accident, or service deficiency caused by any Supplier.
- All Services are subject to the terms, conditions, carriage rules, refund policies, operational requirements, and limitations imposed by the respective Suppliers.
- BOOKING & CONFIRMATION
- All bookings are subject to availability, operational feasibility, and confirmation by the respective Suppliers.
- A booking shall only be considered confirmed upon receipt of the required deposit or full payment as determined by the Company or the relevant Supplier.
- The Company reserves the right to reject, refuse, suspend, cancel, or decline any booking or Customer without assigning any reason.
- Any quotation, itinerary, brochure, advertisement, social media posting, package description, promotional material, or verbal representation is subject to change without prior notice.
- Confirmed bookings are valid strictly for the names, dates, travel periods, destinations, flights, accommodations, and arrangements stated in the booking confirmation.
- No name change, transfer, substitution, or resale shall be permitted after booking confirmation unless approved by the relevant Supplier and subject to additional charges.
- The Customer shall be solely responsible for ensuring the accuracy of all personal particulars, passport details, names, dates of birth, travel documents, and information submitted to the Company.
- The Company shall not be liable for any losses, cancellation, penalties, denied boarding, visa rejection, or travel disruption arising from incorrect or incomplete information provided by the Customer.
- PRICING, SURCHARGES & PAYMENT TERMS
- Package prices, airfare, accommodation rates, transportation charges, taxes, fuel surcharges, airport taxes, port charges, tourism taxes, government taxes, operational charges, visa fees, entrance fees, and other related costs are subject to change without prior notice.
- The Company reserves the right to revise package prices and impose additional charges or surcharges at any time prior to departure or commencement of travel due to circumstances beyond the Company’s reasonable control, including but not limited to:

- fuel price increase;
- airline surcharge adjustments;
- supplier repricing;
- global supply shortages;
- inflation;
- currency fluctuation;
- war;
- geopolitical conflict;
- market instability;
- government policy changes;
- operational cost increases;
- transportation cost increases;
- taxation revisions;
- port or airport authority charges;
- tourism tax revisions;
- or any increase imposed by Suppliers.

- Such additional charges shall be payable by the Customer upon notice by the Company. Failure to make payment may result in cancellation of the booking without refund.
- Upon confirmation of booking, a deposit of fifty percent (50%) of the total fare (or up to 100% depending on specific Supplier requirements) is strictly required to secure the booking.
- Full payment must be settled within the payment deadline specified by the Company.
- Failure to make full payment within the stipulated period or by the deadline shall result in the automatic cancellation of the booking and the immediate, automatic forfeiture of all deposits and payments made, without further notice.
- All payments made are strictly non-refundable unless otherwise agreed in writing by the Company.
- All transactions shall be made in Malaysian Ringgit (MYR) unless otherwise stated.
- Administrative charges, merchant charges, transaction fees, bank charges, currency conversion losses, gateway fees, and international transfer charges shall be borne by the Customer.
- AMENDMENT, REBOOKING & ADMINISTRATIVE CHARGES
- Any request for amendment, postponement, rescheduling, rebooking, change of travel date, change of passenger details, change of itinerary, reduction of services, room changes, transportation changes, activity changes, or modification of any confirmed booking shall be subject to approval by the Company and the respective Suppliers.
- The Customer acknowledges and agrees that any amendment request may result in additional charges imposed by airlines, hotels, resorts, cruise operators, ferry operators, transportation providers, attraction operators, visa authorities, government authorities, local operators, or other Suppliers.
- All additional costs, fare differences, seasonal rate differences, repricing charges, supplier penalties, amendment charges, operational losses, administrative costs, currency fluctuation losses, and any related expenses arising from such amendment requests shall be borne solely by the Customer.
- The Company reserves the right to impose an administrative and processing fee of up to ten percent (10%) of the total booking value, or a minimum fixed sum determined by the Company, plus any actual penalties or fare differences imposed by the Suppliers, whichever is higher, to cover operational, coordination, and manpower costs.
- Any amendment request shall not be deemed confirmed unless acknowledged and approved in writing by the Company and the relevant Suppliers.
- The Company reserves the absolute right to reject any amendment, postponement, rescheduling, or rebooking request without liability, compensation, or refund.
- Any amendment approved by the Company shall remain subject to availability, operational conditions, Supplier approval, revised pricing, and prevailing market rates at the time of amendment.
- STRICT NON-REFUNDABLE, CANCELLATION & REFUND POLICY
- The Customer acknowledges and agrees that the Company acts strictly as an intermediary and that many Suppliers operate under strict non-refundable, non-changeable, and non-transferable policies. All bookings are coordinated through these independent third-party Suppliers.
- Upon confirmation of booking, all deposits, prepayments, and payments paid to the Company shall immediately become strictly non-refundable, non-changeable, and non-transferable under any circumstances.
- Cancellation of any booking by the Customer is strictly non-refundable, whether in full or in part. There shall be no refund or partial refund of any deposit or prepayment made to the Company.
- In the case of cancellation, reduction of room nights, or reduction of passengers, the deposit or prepayment will be forfeited automatically.
- All payments made to the Company shall be fully and automatically forfeited, without any liability or compensation from the Company, in the event of:

- Cancellation by the Customer;
- No-show or missed departure;
- Denied boarding by any carrier;
- Refusal of entry or deportation by immigration authorities;
- Voluntary withdrawal or incomplete travel by the Customer;
- Illness, medical conditions, or injuries;
- Personal or family emergencies;
- Work commitments or business scheduling conflicts;
- Adverse weather conditions or rough sea conditions; OR
- Any other personal, operational, or unforeseen reason whatsoever.

- No refund, credit, or substitution shall be provided for any unused portion of the Services after commencement of travel, including but not limited to accommodation, transportation, meals, sightseeing, attraction tickets, transfers, tours, activities, or optional arrangements.
- The Company shall NOT be responsible, liable, or obligated to refund any amount out of its own pocket. A refund will ONLY be processed if, and only when, the respective Supplier explicitly agrees to and successfully executes a refund to the Company.
- If the independent third-party Supplier refuses to refund the Company for any reason (including Force Majeure), no refund shall be given to the Customer, and the Company shall not be held liable for refunding any amount not refunded by Suppliers.
- Any refund approved and successfully recovered from Suppliers (as per Clause 7.7) shall be strictly subject to the deduction of the Company’s administrative charges, processing fees, bank charges, exchange fluctuation losses, and operational deductions.
- The Customer acknowledges and agrees that refund processing timelines are subject entirely to the respective Supplier’s processing periods and operational constraints, and may require several weeks or months to complete.

- FORCE MAJEURE & EVENTS BEYOND CONTROL
- The Company shall not be liable or responsible for any delay, amendment, disruption, cancellation, loss, injury, damage, inconvenience, financial loss, emotional distress, additional expenses, or operational failure arising directly or indirectly from circumstances beyond the Company’s reasonable control.
- Such circumstances include but are not limited to adverse weather conditions, rough sea conditions, low visibility, storms, floods, earthquakes, volcanic eruptions, tsunamis, pandemics, epidemics, infectious diseases, virus outbreaks, war, terrorism, riots, civil unrest, political instability, border closure, government restrictions, movement control orders, strikes, transportation disruption, fuel shortages, supplier insolvency, airport congestion, port authority restrictions, air traffic control issues, technical failures, accidents, safety concerns, operational difficulties, acts of God, or any unforeseen circumstances.
- Under such circumstances, the Company reserves the absolute right to alter itineraries, postpone travel, substitute transportation, substitute accommodation, rearrange schedules, modify routes, replace activities, shorten tours, extend tours, cancel services, or make any operational decision deemed necessary without compensation or liability.
- Any additional costs incurred as a result of such circumstances shall be borne solely by the Customer.
- TRANSPORTATION & OPERATIONAL CHANGES
- Transportation arrangements may involve airlines, charter flights, helicopters, seaplanes, ferries, speedboats, yachts, cruises, buses, coaches, vans, limousines, trains, trams, cable cars, safari vehicles, private transport, public transport, hot air balloons, or other forms of transportation.
- All transportation schedules, departure timings, routes, seat allocations, baggage allowances, and transportation arrangements are subject to operational conditions, weather conditions, government regulations, safety requirements, and Supplier operational decisions.
- The Company reserves the right to substitute carriers, alter routes, revise departure timings, change transportation types, rearrange seating, or cancel transportation arrangements whenever necessary.
- The Company shall not be liable for any delays, missed connections, denied boarding, overbooking, baggage loss, baggage delay, transportation breakdown, cancellation, sea conditions, turbulence, motion sickness, technical issues, accidents, or transportation-related incidents beyond the Company’s control.
- Customers are solely responsible for arriving punctually at airports, ferry terminals, meeting points, immigration checkpoints, train stations, and departure locations.
- Any losses or additional costs arising from late arrival by the Customer shall be borne solely by the Customer.
- ACCOMMODATION & SUPPLIER ARRANGEMENTS
- Accommodation arrangements may include hotels, resorts, villas, apartments, chalets, homestays, guesthouses, hostels, campsites, glamping facilities, cruise cabins, yacht accommodations, or other lodging facilities.
- Accommodation ratings, room categories, bedding configurations, amenities, facilities, internet access, maintenance conditions, cleanliness standards, utility supply, and service quality may vary according to local standards and Supplier practices.
- The Company reserves the right to substitute accommodations with similar category accommodations whenever operationally necessary.
- The Company shall not be liable for overbooking, maintenance issues, construction activities, utility interruption, hygiene differences, facility closure, dissatisfaction, or accommodation-related issues arising from Supplier operations.
- ACTIVITIES, ADVENTURE & HIGH-RISK ACTIVITIES
- Participation in any activity including snorkeling, scuba diving, freediving, island hopping, hiking, jungle trekking, ATV rides, skiing, safari tours, water sports, helicopter rides, hot air balloon rides, amusement rides, theme park rides, wildlife activities, extreme sports, or any recreational activity is entirely voluntary and at the Customer’s own risk.
- The Customer acknowledges and accepts that such activities may involve inherent risks including injury, illness, drowning, disability, emotional distress, accidents, trauma, or death.
- The Company shall not be liable for any claims, injuries, losses, damages, medical expenses, accidents, or fatalities arising from participation in any activity.
- Customers are responsible for ensuring their own medical fitness, physical condition, swimming ability, health suitability, and travel readiness.
- PASSPORT, VISA, IMMIGRATION & GOVERNMENT AUTHORITIES
- Customers are solely responsible for obtaining and carrying valid passports, visas, transit visas, permits, vaccination certificates, travel authorizations, health declarations, customs declarations, insurance requirements, and all documents required by the relevant authorities.
- Passport validity requirements vary according to destination and remain entirely the responsibility of the Customer.
- Approval of visas, permits, landing visas, e-visas, immigration clearance, customs clearance, border entry, transit approval, or travel authorization shall remain solely at the discretion of the relevant embassies, consulates, immigration authorities, customs authorities, border control authorities, aviation authorities, marine authorities, tourism authorities, health authorities, enforcement agencies, and government bodies.
- The Company does not guarantee approval of any visa, permit, immigration clearance, landing visa, border entry, or travel authorization under any circumstances.
- The Company shall not be liable for visa rejection, refusal of entry, denied boarding, deportation, detention, blacklisting, confiscation, customs seizure, permit rejection, quarantine orders, overstay penalties, criminal investigations, or any enforcement action imposed by any authority.
- Any cancellation, forfeiture, financial loss, accommodation loss, airfare loss, transportation loss, or additional expenses arising from such matters shall be borne solely by the Customer.
- CUSTOMER RESPONSIBILITY & CONDUCT
- Customers shall comply with all laws, regulations, safety instructions, customs requirements, health requirements, and instructions issued by authorities, tour leaders, guides, transportation operators, and Suppliers.
- Customers are solely responsible for monitoring travel schedules, checking departure timings, ensuring punctuality, maintaining communication accessibility, managing personal health conditions, and safeguarding personal belongings.
- The Company reserves the absolute right to refuse, remove, terminate, or cancel the participation of any Customer whose conduct is deemed disruptive, abusive, violent, intoxicated, dangerous, unlawful, offensive, threatening, or detrimental to the Company, Suppliers, staff, tour leaders, or other travelers.
- No refund or compensation shall be provided in such circumstances and all resulting costs shall be borne by the Customer.
- PERSONAL BELONGINGS & BAGGAGE
- Customers are solely responsible for safeguarding their baggage, valuables, travel documents, electronics, cash, sports equipment, diving equipment, and personal belongings at all times.
- The Company shall not be liable for any loss, theft, delay, damage, confiscation, mishandling, or disappearance of baggage or personal belongings occurring during the travel period.
- TRAVEL INSURANCE
- Unless specifically stated otherwise, no insurance coverage is included in the package price.
- Customers are strongly advised to purchase comprehensive travel insurance covering medical expenses, accidents, evacuation, trip cancellation, travel disruption, baggage loss, personal liability, adventure activities, and force majeure events.
- DIGITAL COMMUNICATION & ELECTRONIC CONFIRMATION
- Any communication, booking confirmation, itinerary, invoice, quotation, receipt, travel voucher, or acknowledgment transmitted electronically through email, WhatsApp, messaging applications, websites, online systems, or digital platforms shall be deemed legally valid and binding.
- Electronic records, payment slips, screenshots, online confirmations, and digital correspondence may be used as evidence in the event of any dispute.
- SOCIAL MEDIA, DEFAMATION & REPUTATIONAL PROTECTION
- The Customer agrees that any dispute, grievance, or dissatisfaction regarding the Services shall be shared and resolved privately through the Company’s official customer service channels.
- The Customer shall not publish, distribute, upload, post, transmit, or circulate any false, misleading, defamatory, malicious, or damaging statements, reviews, or videos regarding the Company, its brand, employees, staff, Suppliers, or business operations.
- The provisions under Clause 17.2 shall apply to all public forums, review sites, social media platforms (including but not limited to Facebook, Instagram, TikTok, Xiaohongshu), and digital messaging groups.
- In the event the Customer breaches this Clause while a tour or service is actively ongoing, the Company reserves the right to terminate any remaining Services for the affected Customer without refund or compensation, and any subsequent expenses incurred shall be borne by the Customer.
- The Company reserves all legal rights to seek appropriate remedies, including compensation for reputational damage or financial losses, arising directly from any prohibited defamatory actions.
- CHARGEBACK, PAYMENT DISPUTE & RECOVERY
- Customers shall not initiate any unjustified chargeback, fraudulent payment reversal, banking dispute, or payment recovery claim after services have been confirmed, arranged, booked, or utilized.
- In the event of any payment dispute or chargeback, the Company reserves the right to recover all outstanding sums, legal costs, administrative charges, collection fees, operational losses, and related damages.
- LIMITATION OF LIABILITY
- To the fullest extent permitted by law, the Company shall not be liable for any indirect, consequential, incidental, emotional, reputational, punitive, special, or economic losses including loss of enjoyment, disappointment, emotional distress, business interruption, or loss of profits.
- The Company’s total maximum liability, if any, shall not exceed the amount actually paid directly to the Company for the affected service component only.
- PERSONAL DATA PROTECTION ACT (PDPA) 2010
- By making a booking or providing personal data to the Company, the Customer explicitly consents to the collection, usage, storage, and processing of their personal data (including sensitive data such as passport details, medical conditions, and dietary requirements) by the Company in accordance with the Malaysian Personal Data Protection Act 2010.
- The Customer authorizes the Company to disclose and transfer such personal data to independent third-party Suppliers (both local and international) such as airlines, hotels, transport operators, tour guides, and visa authorities solely for the purpose of executing and fulfilling the travel arrangements.
- FINAL ACKNOWLEDGEMENT

- By making payment, confirming a booking, participating in any tour, or utilizing any service arranged by the Company, the Customer acknowledges and agrees that travel involves inherent risks, uncertainties, operational changes, and circumstances beyond the Company’s control.
- The Customer further acknowledges that he/she has read, understood, accepted, and agreed to all Terms & Conditions stated herein.
